Most private child law work is handled on a fixed fee, agreed and confirmed in writing before we start. Where a local authority is involved in care proceedings, Legal Aid is usually available regardless of your income. Facing care proceedings? You may not have to pay

If a local authority has started care proceedings about your children, it is one of the most frightening things a parent can face. You do not have to go through it without a solicitor, and in most care cases the cost is not a barrier. Legal Aid for care proceedings is usually available to parents regardless of income, when a local authority brings a case under section 31.

Frequently Asked Questions

Is it still called child custody?

Not in England and Wales. The courts replaced “custody” and “access” with child arrangements orders in 2014, which set out who a child lives with and spends time with. Many parents still use the word custody, and we are happy to talk it through in whichever terms feel natural to you.

Most private child matters are handled on a fixed fee, agreed in writing before we begin. The fee depends on whether things can be agreed or need a court application. Care proceedings brought by a local authority are usually covered by Legal Aid. Start with a free initial phone consultation and we will explain the likely cost.

Often not. Many arrangements are agreed between parents, sometimes with the help of mediation, and the court is generally a last resort. Where agreement is not possible, or a child’s welfare is at risk, a court application may be necessary and we can represent you.

 

Get advice as soon as you can. Care proceedings move quickly under a fixed timetable, and early representation matters. Legal Aid is usually available for parents in these cases regardless of income, so cost should not stop you seeking help.
