Under the no-fault divorce process, a straightforward divorce usually takes around six to eight months from start to final order, partly because of a fixed twenty-week reflection period built into the law. Financial matters run alongside and can take longer if they are contested.
Often not. Many separations are resolved by agreement, and we can make that agreement legally binding through a consent order without a contested hearing. Court becomes necessary mainly where matters cannot be agreed, or where urgent protection is needed.
A consent order is a court-approved document that makes your financial agreement legally binding and final. Without one, a former spouse can bring a financial claim against you years later, so we usually recommend getting one even where things are amicable.
